Welcome to UsedEmoto. By accessing or using our marketplace platform to browse, buy, or sell electric dirt bikes, parts, or accessories, you agree to comply with and be bound by these Terms of Service.

1. Our Role in the Marketplace UsedEmoto provides a community platform connecting local buyers and sellers of electric dirt bikes (e-motos), components, and riding gear.

• We are a venue and do not own, inspect, certify, or guarantee any items listed by users.
• Every transaction and communication is strictly between the buyer and the seller.
• UsedEmoto is not responsible for the physical condition, safety, roadworthiness, or legality of any bike or part bought or sold.

2. Off-Road Use Only ⚠️ CRITICAL NOTICE: Electric dirt bikes (including Sur-Ron, Talaria, 79Bike, E-Ride Pro, Segway, and similar models) purchased or sold through UsedEmoto are intended strictly for off-road use only.

• E-motos are generally not street-legal out of the factory in most jurisdictions and public roadways.
• It is solely the buyer's and rider's responsibility to understand and strictly obey all applicable federal, state, and municipal laws, regulations, and trail rules regarding where these vehicles can be legally operated.
• UsedEmoto assumes zero liability for citations, impoundments, fines, or legal actions resulting from the unlawful operation of vehicles on public streets or restricted areas.

3. Assumption of Risk & Safety Riding electric dirt bikes is an inherently dangerous action sport involving significant risk of severe bodily injury, disability, property damage, or death.

• Modifying e-motos (such as aftermarket battery upgrades, higher voltage controllers, suspension tuning, or motor swaps) carries additional risks of electrical malfunction, fire, or mechanical failure.
• By using UsedEmoto, you expressly acknowledge and voluntarily assume all risks associated with purchasing, building, modifying, testing, and riding used e-motos and aftermarket parts.
• Always wear a full-face helmet, proper protective equipment, and conduct a thorough mechanical and electrical inspection before riding.

4. User Conduct & Fraud Prevention We are committed to maintaining a trustworthy, scam-free community:

• You agree never to post misleading, fraudulent, or counterfeit listings.
• Selling stolen goods or battery packs with obliterated serial numbers is strictly prohibited and will be reported to law enforcement.
• Any attempt to scam, harass, phish, or defraud community members will result in immediate and permanent account termination.

5. "As-Is" Sales & Due Diligence Unless an explicit written warranty is provided directly by a verified merchant or seller:

• All bikes, batteries, motors, and parts on UsedEmoto are sold strictly "as-is, where-is", with all faults, and without warranties of any kind, whether express or implied.
• Buyers are strongly encouraged to inspect the item in person, verify battery health, check the frame and VIN/serial numbers, and test functionality prior to completing payment.
